  • Terms and Conditions - this document, specifying the rules of Fly On The Cloud acting as a service reseller
  • Reseller - Fly On The Cloud sp. z o.o. (LLC) with its headquarters in Wrocław, ul. Rzeźnicza 32/33, 50-130 Wrocław, entered into the Register of Entrepreneurs kept by the District Court for Wrocław Fabryczna, Department VI of the National Court Register, under KRS number 0000500884, NIP 8971797086 -- the official partner of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland
  • Digital Partner Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, IrelandClient - an entrepreneur, a natural or legal person
  • Digital Product - IT and cloud services offered by the Digital Partner, in particular Google GSuite.
  • Data Controller - a natural or legal person, public authority, agency or any other body which alone or jointly with others determines the purposes and means of the processing of personal data;
  • The Reseller is Controller of personal data processed in connection with the functioning of the Platform.
  • Platform - operated by Reseller and available under the address www.flyonthecloud.hu the platform enables clients to contact the Reseller and initiate the process of purchasing Digital Products through the Reseller.

§1

Definitions

  1. Reseller provides Customer with a Platform through which Customer can access the range of Digital Products offered by Reseller. The Customer can access the current version of Terms and conditions at any time at: www.flyonthecloud.com/regulamin
  2. All information on Digital Products is for reference purposes only and does not constitute an offer within the meaning of civil law.
  3. Reseller is an intermediary in the sale of Digital Products delivered directly by the Digital Partner.Digital Products are provided by the Digital Partner. These products are licensed by Digital Partner in accordance with Digital Partner's conditions: https://gsuite.google.com/intl/en/terms/reseller_premier_terms.html
  4. After the purchase, Digital Products can be activated on a specific date of purchase selected by the Client. The Client is charged a monthly fee for the Digital Product from the date of activation for the period for which the service was purchased. Reseller can offer trial periods and discounts for selected Digital Products. Digital Products can be purchased for an indefinite period in a flexible option allowing to cancel the subscription with a 1-day notice period, or for a period of 365 days from the date of activation of the Digital Product.
  5. Digital Product subscription plans are negotiated individually between the Reseller and Client.Reseller is not the licensor of the Product. Client concludes the license agreement directly with the licensor, i.e. Digital Partner.The conclusion of the license agreement between the Customer and the licensor takes place by accepting the agreement specifying its terms during the installation / first use of the Product.
  6. Proper operation of the Platform requires minimum technical requirements to be met by the Customer:Processor:
    1000 MHz,
    RAM: 512 MB,
    Internet connection,
    Browser: HTML5, CSS3 and JavaScript support;
    enabled cookies, or a mobile device equipped with an internet browser.

CONTACT WITH RESELLER

  1. For inquiries on Digital Products, Reseller can be contacted through the following channels:

  2. In the event that the Client decides to purchase a Digital Product through Reseller, the transaction will be possible provided that the Client provides the following data:

    E-mail address
  3. Full responsibility for the correctness of the data indicated in paragraph 2 shall be borne by the customer.The Client is not entitled to return fully functional Digital Products.The purchase of Digital Products requires the conclusion of a contract between the Customer and Reseller and Client's acceptance of the conditions on which the Digital Partner makes the given Digital Product available, expressed by the Customer's acceptance terms and conditions of the license granted by Digital Partner.
  1. Digital Products prices are expressed in EUR / USD
  2. Payments for Digital Products can be made
    via the PayU payment gateway,
    with a bank transfer,
    with a credit card
  3. VAT invoices for Digital Products are delivered to the customer in the billing cycles appropriate for a given Digital Product, usually on a monthly basis.

DELIVERY

The services offered by Reseller are not available to consumers or natural persons whose legal transactions with the Reseller are not directly related to their business or gainful activity. For the removal of doubt, Reseller informs that the services and products provided by him are addressed only to businesses (B2B relationship) and the provisions of consumer rights do not apply.

  1. The complaint procedure and the service level for individual Digital Products are specified in the license agreement to which the Client and the Digital Manufacturer are parties.

COMPLAINTS AND WARRANTY

  1. Detailed information about personal data, the rights of the Client, and Reseller's obligations in this respect are included in the Privacy Policy available at: www.flyonthecloud.hu/policy
  2. Reseller meets the PCI DSS (security for card payment) standard and provides the 3D secure authentication support.
  3. The rules for the processing of personal data in Digital Products are set out in the Digital Partner's Privacy Policy - https://policies.google.com/privacy?hl=pl. Google also offers model contract clauses approved by the European Commission for Clients using their services to ensure adequate protection of personal data when the data is transferred outside the EEA. The content of the data processing agreement can be found at https://gsuite.google.com/terms/dpa_terms.html. Client can accept Google’s personal data processing agreement and model contract clauses via the Google administration platform. The list of server locations in which personal data entrusted by the Customer can be processed is always available at https://www.google.com/about/datacenters/inside/locations/index.html. Additionally, as part of ensuring an adequate level of personal data protection, Google Inc. adheres to the principles set out under the EU-US Privacy Shield program by the US Department of Commerce that regulate the collection, use and storage of personal data of European Union citizens, which aims to provide an additional requirement for their security (https://www.google.com/intl/pl_pl/policies/privacy/frameworks/).

PROCESSING OF PERSONAL DATA AND SECURITY

  1. These Terms and Conditions may be updated and changed. Its most current version will always be available at: www.flyonthecloud.hu/terms Customers will also be notified of any changes to the email address provided during registration.
  2. These Terms and Conditions have been in force since 3.12.2019.In the event of any disputes, the Parties (i.e. the Client and the Reseller) shall endeavor to resolve them amicably. If an amicable settlement of the dispute is not possible, the court having jurisdiction over the seat of the Intermediary will be the court competent to resolve the dispute, and the applicable law will be Polish law.
